These Terms & Conditions apply to quotations, bookings and catering services provided by Kumairi Taste of Home.
1. General
These Terms & Conditions apply to quotations, bookings and catering services provided by Kumairi Taste of Home.
Any deviation from these Terms & Conditions is valid only if agreed in writing between Kumairi Taste of Home and the customer.
Specific arrangements concerning the event date, location, number of guests, menu, package, service level and price are set out in the quotation or booking confirmation.
2. Quotation and formation of the agreement
Submitting a request through the website does not constitute a definitive booking.
A booking becomes definitive only when:
- the customer has accepted the final quotation;
- the customer has accepted the applicable Terms & Conditions; and
- Kumairi Taste of Home has received the required 30% deposit.
Until these conditions have been met, the requested event date is not definitively reserved.
The final quotation will specify, where applicable:
- event date and location;
- number of guests;
- selected package and/or menu;
- selected service level;
- transport costs;
- any agreed additional charges;
- total agreed price;
- payment arrangements.
The customer is responsible for checking this information and notifying Kumairi Taste of Home of any errors without undue delay.
3. Prices
The agreed price is stated in the quotation.
Transport costs, supplements and other agreed additional charges will be shown separately or included in the agreed total price.
If the customer requests changes after confirmation that result in additional costs, those changes will only be carried out after the parties have agreed on the additional costs.
4. Payment
A deposit of 30% of the total agreed price is payable upon definitive confirmation of the booking.
The remaining 70% must be paid no later than 7 days before the event, unless otherwise agreed in writing.
The deposit forms part of the total agreed price and is not a separate surcharge.
If the customer cancels the booking, any deposit already paid will be credited against the applicable cancellation costs under Article 5.
5. Cancellation by the customer
The customer must notify Kumairi Taste of Home of a cancellation in writing, for example by email, as soon as possible.
The following cancellation schedule applies as a starting point:
- more than 14 days before the event: 0%;
- 8 to 14 days before the event: 25%;
- 3 to 7 days before the event: 50%;
- less than 48 hours before the event: up to 100% of the agreed price.
Cancellation costs will only be charged insofar as they are reasonable in the circumstances.
Relevant circumstances may include work already performed, unavoidable costs, products or ingredients already purchased, capacity or staff already committed, and losses reasonably incurred as a result of the cancellation.
If the actual and reasonably justifiable cancellation costs are lower than the amount resulting from the percentages above, this will be taken into account.
6. Special or limited-availability ingredients
Some Kumairi Taste of Home dishes require specialised, particular or limited-availability ingredients. Such products may need to be purchased well in advance for a specific booking.
If, before cancellation, Kumairi Taste of Home has already purchased special, limited-availability or otherwise order-specific ingredients or products that cannot reasonably be reused without loss, the actual and reasonably unavoidable costs may be charged to the customer.
Kumairi Taste of Home can substantiate such costs upon reasonable request.
7. Changes to the number of guests
The final number of guests may be adjusted up to 48 hours before the start of the event.
A reduction in the number of guests within 48 hours of the event will generally no longer result in a reduction of the agreed price.
An increase in the number of guests within this period is possible only with the approval of Kumairi Taste of Home and where it is practically possible to accommodate the additional guests. Additional guests will be charged accordingly.
If special or non-reusable products have already been purchased for the original number of guests before a timely reduction is made, the associated reasonably unavoidable costs may still be charged.
8. Menu and changes
Requests to change the agreed menu may be submitted up to 7 days before the event.
After this deadline, changes can only be made with the approval of Kumairi Taste of Home and where availability and preparation allow.
If special or limited-availability ingredients have already been purchased for the original menu and cannot reasonably be used for another booking, the associated unavoidable costs may be charged.
9. Allergens and dietary requirements
The customer must notify Kumairi Taste of Home in writing of known allergies, serious food intolerances and specific dietary requirements no later than 7 days before the event.
Kumairi Taste of Home will take these requirements into account as far as reasonably possible and will provide allergen information where applicable.
Different ingredients and allergens are handled in the Kumairi Taste of Home kitchen. Despite careful working practices, the possibility of cross-contact cannot be completely excluded in all circumstances.
Serious allergies must therefore be explicitly communicated in advance. Kumairi Taste of Home will then assess whether the relevant order can be prepared and supplied responsibly.
The customer is responsible for providing complete and timely information concerning the allergies and dietary restrictions of the guests.
10. Transport and event location
Transport costs are calculated according to the event location and selected service, as specified in the quotation.
The customer is responsible for providing a complete and accurate event address.
The customer must inform Kumairi Taste of Home in advance of circumstances at the venue that could reasonably affect delivery or performance, including:
- restricted loading or unloading access;
- an unusually long distance between parking and the event space;
- access to multiple floors without a suitable lift;
- special venue access requirements;
- other relevant logistical restrictions.
Circumstances not disclosed in advance that demonstrably result in reasonable additional costs may be charged separately.
Necessary exceptional parking or access costs that could not reasonably have been included in advance may also be charged where reasonable.
If Kumairi Taste of Home chooses, as part of a service booking, to remain nearby until equipment can be collected, this does not automatically result in additional transport charges for the customer.
11. Materials, tableware and equipment
Where Kumairi Taste of Home provides materials such as tableware, chafing dishes, serving equipment, presentation stands or decorative items, these must be handled with reasonable care.
Normal wear resulting from ordinary use will not be charged to the customer.
If materials are lost, broken or otherwise damaged during the event as a result of the actions of the customer or their guests, Kumairi Taste of Home may charge the reasonable actual cost of repair.
Where repair is not reasonably possible, the reasonable replacement value may be charged.
The customer is not responsible for damage resulting from normal wear and tear, technical defects, or actions of Kumairi Taste of Home or its personnel.
12. Performance of the service
Kumairi Taste of Home will perform the agreed catering service with reasonable care and in accordance with the confirmed quotation.
Minor changes to presentation or ingredients may occasionally be necessary due to availability or quality.
Where a material change is required, Kumairi Taste of Home will, where reasonably possible, discuss this with the customer in advance.
A material change that significantly affects the nature or value of the agreed service will not be imposed on the customer without an appropriate solution.
13. Force majeure
If performance becomes wholly or partly impossible due to circumstances outside the reasonable control of Kumairi Taste of Home, Kumairi Taste of Home will inform the customer as soon as reasonably possible.
The parties will, where possible, seek a reasonable solution, such as adapting the service or agreeing on an alternative method of performance.
For parts of the service that definitively cannot be performed due to force majeure, no payment will be required insofar as no service has been provided and no reasonable non-recoverable costs have already been incurred.
14. Liability
Kumairi Taste of Home is liable for damage insofar as such liability follows from applicable law and the damage can legally be attributed to Kumairi Taste of Home.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.
Kumairi Taste of Home is not responsible for damage resulting directly from incorrect, incomplete or late information supplied by the customer, insofar as Kumairi Taste of Home could reasonably rely on that information.
This may include, for example, an incorrect event address, undisclosed access restrictions or allergy information that was not provided in time.
15. Complaints
If the customer has a complaint or encounters a problem during the event, the customer is requested to notify Kumairi Taste of Home as soon as possible so that an appropriate solution can, where possible, be offered immediately.
Where immediate notification is not reasonably possible, the customer may submit the complaint in writing as soon as reasonably possible after the event.
Kumairi Taste of Home will handle complaints carefully and will seek an appropriate solution together with the customer.
16. Consumer rights
Nothing in these Terms & Conditions limits any mandatory rights granted to consumers under Dutch consumer law.
Where applicable law gives a consumer additional rights in a particular situation, those mandatory statutory rights prevail over any conflicting provision in these Terms & Conditions.
17. Governing law and disputes
Agreements with Kumairi Taste of Home are governed by Dutch law.
In the event of a dispute, Kumairi Taste of Home and the customer will first attempt to resolve the matter through consultation.
If no solution can be reached, the dispute may be submitted to the court having jurisdiction under Dutch law.
18. Availability of these Terms & Conditions
These Terms & Conditions are available through the Kumairi Taste of Home website.
Before or when entering into a definitive agreement, the customer will be given a reasonable opportunity to read and save the applicable Terms & Conditions.
